对吴征在《北京青年报》上的自我辩护的两点质疑

读者Yi Zhu来信的要点:

一、吴征说密苏里的案件是控告他的雇主大都会保险公司,而不是他,他是自
愿离开该公司而不是被开除。根据公布的法庭纪录,法庭认为该案类似于以前
的另一案件,在那个案件中办事人员被公司要求辞职,否则将被开除。同时法
庭认为,没有证据表明保险公司指导吴征欺诈,所以不应该对吴征的所作所为
负责任。原告控告保险公司而不是吴征,可能是因为公司能支付赔偿,而吴征
不能。

二、吴征担任的是“国际艾米奖”庆祝活动的“晚宴主席”(Dinner Chairman)。
晚宴主席不是颁奖典礼的主席,“国际艾米奖”也不是大名鼎鼎的美国“艾米
奖”,不会有2亿人收看。吴征声称“出任了这次国际艾美奖颁奖典礼的主席,
而且还在颁奖前发表了祝贺演说,好在全世界应该有两亿人看到了”,是对公
众的误导。

Evidence against Bruno Wu's defense for himself

Bruno Wu, the co-chairman of Sina.com, issued a defense on todays 
dailynews.sina.com.cn website, stating that the lawsuits against him in 
Missouri was against his employer, MetLife, instead of him and also stating 
that he was not fired by MetLife but voluntarily left.

However, here is what I have found in the court document, which can be found 
in many places but also hosted on xys.org:

In the middle of the last paragraph (the longest one which ends with 
"concur"):

"Another Vice President of Mutual
subsequently informed the plaintiff of the "company's
decision" that he should resign or be terminated if he
refused."

"The present case is analogous to
Emerick. Here, there was no evidence that MetLife expressly
directed Wu to make misstatements and plaintiffs fail to
identify any superior who directed Wu to make any
misstatements. Because there is no evidence that MetLife
directed or intended Wu to [**12] make false representations
, the converse instruction properly refers to Wu's rather
than MetLife's knowledge of the falsity of the
representations."

My assumption is that the plaintiff had a motive to suit the firm rather 
than Bruno Wu, because the firm could pay damages but Wu couldn't.  However, 
the court denied the firm's reponsibility.

Also, in today's interview, Wu also alleged that the Emmy award ceremony was 
watched by 200 million people as he made the speech.

What he attended was, first of all, the International Emmy, and not the Emmy 
as we know.  Second, Bruno Wu was the "Dinner Chairman" of the Gala Event.  
The Gala Event was by no means watched by 200 million people.

The fact is that Wu did not give any speech in the widely publicized Emmy 
ceremony. By making the claims that he handed out awards in Emmy, Bruno Wu 
is misleading the public.

BERGERON TO HOST 29th INTERNATIONAL EMMY AWARDS GALA FOR SECOND YEAR

NEW YORK, September 10, 2001 - The International Council of The National 
Academy of Television Arts & Sciences (NATAS) announced that award-winning 
television personality and host of Hollywood Squares, Tom Bergeron, will 
host the 29th Annual International Emmy Awards Gala Event, for the second 
year in a row, on November 19 in New York. Joining him, as presenters will 
be two-time International Emmy Award winners Jennifer Saunders & Joanna 
Lumley, stars of the BBC and Comedy Central sitcom, Absolutely Fabulous, and 
globally popular actor Roger Moore. Other presenters will be announced 
shortly.

Bruno Wu, Executive Chairman of Sun Television China and Pat Mitchell, 
President & CEO of Public Broadcasting System (PBS) have been named Dinner 
Chairpersons of this year's event. Nominees for the International Emmy 
Awards will be announced at MIPCOM in Cannes, France on October 8th.

"We have some really terrific talent joining us this year for our most 
important annual event," said Fred Cohen, President of the International 
Council of NATAS. Mr. Cohen is also President of King World International 
Productions and Executive Vice President, CBS Broadcast International. 
"We're very happy to have Tom Bergeron back as host this year. Last year he 
proved to be a perfect fit, making the evening exciting as well as 
entertaining. With stars of the caliber of Roger Moore and the ladies of 
Absolutely Fabulous joining him onstage, we truly have a marvelous group of 
entertainers who reflect the quality of our organization."

Mr. Bergeron won the 2000 Emmy Award for "Outstanding Game Show Host" for 
his work on Hollywood Squares, the top-rated game show that is broadcast 
worldwide. He previously served as host of the critically acclaimed FX 
network talk show Breakfast Time, as well as its equally praised FOX network 
version Fox After Breakfast. In addition, Mr. Bergeron has been substitute 
anchor for the ABC morning news broadcast Good Morning America, and has 
worked extensively in local radio and television. Recently, he returned to 
morning television by co-hosting CBS' The Early Show for a week, and jumped 
to primetime as this season's host of ABC's America's Funniest Home Videos.

Mr. Moore, who will present the UNICEF/International Council Broadcast 
Awards this year, is best known for his role as 007 in seven James Bond 
films from 1973 to 1985 and his role in the television series The Saint from 
1962 to 1965. In recent years, he has replaced Audrey Hepburn as Special 
Representative for the Film Arts for UNICEF, raising funds for children in 
developing countries. The British government has also honored Mr. Moore, 
receiving a CBE (Commander of the British Empire) award in March 1999.

Although she has been a featured in such popular British television shows as 
Top Girls, Eat the Rich and Happy Families, Ms. Saunders is best known as 
the writer and co-star of the sitcom Absolutely Fabulous, and as one-half of 
the popular British comedy team French & Saunders, with Dawn French. Ms. 
Saunders has also appeared in the films Spice World, Muppet Treasure Island 
and A Midwinter's Tale.

Also best known for her role in Absolutely Fabulous, Ms. Lumley began her 
career in the James Bond film On Her Majesty's Secret Service. She went on 
to star in the television shows The New Avengers and Sapphire and Steel in 
the 1970s. Ms. Lumley has also appeared in two Pink Panther films and in the 
films Shirley Valentine, Cold Comfort Farm and James and the Giant Peach.

This year's Directorate Emmy Award will be presented to Gustavo Cisneros, 
Chairman, Cisneros Group of Companies. The Directorate Emmy Award honors 
individuals or organizations for their outstanding contributions to the arts 
and sciences of international television. Prior industry giants who have won 
the award include Ralph Baruch, founder of Viacom; Herb Granath, Chairman, 
Disney/ABC; Su-Ming Cheng, Chairman of China Television; Sam Nilsson, 
Director General of Swedish Television; and John Birt, Director General, 
BBC, among others.

The Founders Emmy Award will be presented to Pierre Lescure, Chief Operating
